Contacting the Controller
Questions about how personal data are processed, as well as requests by which you exercise your rights, should be sent to contact@fortuna-recenze.cz. They are dealt with by the controller, namely the operator of fortuna-recenze.cz, which is responsible for data processing on this website.
What We Process and What We Do Not
Processing is limited to what is necessary for the operation, security and analytics of fortuna-recenze.cz, or for handling an email enquiry.
We process:
- technical access data (IP address, time, URLs visited, device, browser, operating system) for running, securing and analysing the website;
- cookies, under the rules set out in the Cookies part;
- data from messages sent to contact@fortuna-recenze.cz: email address, text and a signature if you add one.
We do not process:
- data connected with gambling,
- data used for identity verification,
- payment transaction data,
- data of Fortuna players.
Purposes of Processing at a Glance
- Running and protecting the website
Legal basis: the controller's legitimate interest, Art. 6(1)(f) GDPR.
Retention: 12 months at most, or as technical capabilities allow. - Analytical and marketing cookies
Legal basis: your consent, Art. 6(1)(a) GDPR.
Retention: until consent is withdrawn, or as your browser settings determine. - Replies to emails
Legal basis: performance of a contract or legitimate interest, Art. 6(1)(b) or (f) GDPR.
Retention: for as long as the enquiry is being handled, no more than 6 months.
The framework for all of this is set by the General Data Protection Regulation, (EU) 2016/679, by the Czech Act No. 110/2019 Coll. on personal data processing and, as far as cookies are concerned, by § 89 of the Electronic Communications Act, No. 127/2005 Coll.
Range of Recipients
The range of those who may gain access to personal data is limited to running the website and to analytics. It includes:
- companies providing hosting and CDN, without which the pages would not be live, available and protected;
- web analytics services, which turn statistical traffic data into input for optimising the website.
We do not pass data to anyone else, whether unverified entities or third parties without a legal basis. Provider names are given only where they are publicly identifiable directly on the website.
Data and Third Countries
A third country means a state outside the EU and the EEA. Data are transferred there if we use an analytics tool from a provider that is established neither in the European Union nor in the European Economic Area. Such a transfer is then governed by standard contractual clauses under Art. 46 GDPR, which secure an appropriate level of protection for personal data. Without a service outside the EU/EEA, no such transfer occurs.
List of Your Rights
Seven rights are available to you as a data subject under the GDPR and Act No. 110/2019 Coll.:
- Access. You can find out which of your personal data we process (Article 15 GDPR).
- Rectification. You can have inaccurate data corrected (Article 16 GDPR).
- Erasure. The so-called “right to be forgotten” can be exercised if the conditions of Article 17 GDPR are met.
- Restriction. Processing can be restricted at your request (Article 18 GDPR).
- Portability. It concerns automated processing based on consent or a contract (Article 20 GDPR).
- Objection. It is directed against processing based on legitimate interest (Article 21 GDPR).
- Withdrawal of consent. Possible where consent is the legal basis; it does not affect the lawfulness of earlier processing.
Submitting a Request
The deadline for responding to a request is 30 days from its receipt at most, and the controller deals with it without undue delay. In more complex cases, or where many requests are received, it may be extended by a further two months; you will be notified if so. To submit a request, simply write to contact@fortuna-recenze.cz.
Contacting the ÚOOÚ
Besides writing directly to the controller, you also have the right to complain to the supervisory authority if you believe the processing of your data violates the law. That authority is the ÚOOÚ: Office for Personal Data Protection (Úřad pro ochranu osobních údajů), Pplk. Sochora 27, 170 00 Praha 7 (www.uoou.cz).
Securing Access and Transmission
We protect personal data on two levels. During transmission between the user's device and the server, they are secured by the HTTPS/TLS protocol. While stored, they are shielded from unauthorised access by technical and organisational measures based on the current state of the art. The controller regularly evaluates both and takes steps to keep the risk of unauthorised access and data misuse to a minimum.
